re storm damage

my vehicle was damaged in a storm, the vehicle is in need of repairs not due to the storm all cosmetic i have full coverage the adjuster from my ins co came down did the estimate i still owe on the vehicle can the ins co issue me the check so i can get part of the damage fixed as well as the repairs or does the leinholder get the check>IN MA PLEASE ADVISE

The check should either have your name and the lien holders name or your name and the body shops name on it. But sometimes if the amount is very low they will just include the insured. On the other hand, some carriers always put two names on the check if there is a lien holder.

If the "cosmetic" stuff is due to maintenance/wear and tear factors, not the result of collision or other covered losses under the "other than collision" (or, comprehensive) part of your policy, it is not covered, and you should not receive any compensation for it.

Either way, as tcope has written, if you are not the "legal owner", that party's name will usually also be on the check that has your name on it. It helps to guarantee that the repairs are made.

Does this mean that if the amount is low then the insurer doesn't care whether the repairs are done or not?

It does not matter much to the insured what happens to the money when it leaves the building. They have an obligation to settle the claim, that is all.
