my tenant called me said his mother in law had fell down the stairs and fractured her shoulder,should I be concerned?.

My stairs are well built and highly visible morning and night,has railings and and is sturdy.

I told the tenant that if the person did not have the ability to climb stairs because of their age they should not ,and its not my fault if they were not careful and that I wont stand for them to scam my insurance company

If you piss them off enough... probably.

This person's mother might not have any way to pay for her medical treatment. Treatment could run $5,000 or more... easily. If you had this kind of debt would you look into ways of getting the bills paid? You may feel that the stairs were in perfect order but there are two sides to every story. Accusing someone of defrauding your carrier right after they were hurt might not be the best move.

If there are actual broken bones, you're going to have a hard time proving "fraud". What old lady is going to do that to herself just to collect a few bucks from an insurance company?

Having said that, if there is no negligence on your part (no failure of the stairs that caused her loss, as according to your post), she's still entitled to medical payments courtesy of your policy because the injury happened on your premises. That's what you have the coverage for-- it's essentially "no fault" coverage. The pain and suffering stuff -- that's what all the arguing will be over.

Just turn this over to your insurance company, cooperate with them, and let them handle it as they see fit. Insurance companies don't often voluntarily pay more than they are entitled to pay.

That's one important thing that all of us should remember!
If the mishap took place due to vision problem, then also the lady deserves compensation.
