PLZ Help, Adjuster not offering Enough $$$

The accident was not my fault, fault has been determined and the at fault driver cited, the adjuster has agreed my car is totaled but she is only offering 4200. I have found the only cars like mine listed for sale.in a 200 mile radius of where I live in NC .They list for 5995 to 8995. + tax doc fees and tags . I had a car and I should get what ever it takes to replace my car as if the accident never happend. What can I do? Please Help

What is the NADA price on the vehicle? What you have found is _asking_ prices. These are not values or selling prices. Have you reviewed the insurance companies info to confirm that it's correct? If not, how can you know that their offer is not correct/fair?

You need to obtain their documentation and review it to make sure that it's correct or not.

nada clean trade in 5700, clean retail 7800. I have went over my car info twice with the adjuster over the phone I have never seen anything in writing. She told me 4300 was her last offer that she had gotten the amount from "CC", a system she uses that can tell her what a car like mine has sold for in the area. She is very rude and condesending.
I do not understand this, I had a car before her insured driver totaled it. Shouldn't the at fault driver insurance company have to pay whatever it costs to replace my car?
What do I do if she (the adjuster) keeps insisting this is her final offer? Do I complain to her company, do I sue the ins co, or the driver? This really sucks. All I want is what it would take to go buy a car exactly like I had.

I'm sorry if I am coming off like a jerk, I am just overwhelemed, I was not looking to sell or trade in my car so I don't see what that has to do with it. Because of the other driver I am now looking to BUY a car.

CCC.... Pathway. They furnish a report that can easily be 20 pages long.

The _big_ problem is that this report is "garbage in, garbage out". A form is filled out so that CCC can run the value of the vehicle. The problem is that appraisers seldom fill in the correct information or all of the information. I've seen them leave out sunroofs and navigation systems. In many cases the CCC form does not have boxes to check off for some options.

You need to review the options that were submitted to CCC and even the mileage of the vehicle. You also need to make sure the 2-3 vehicles chosen out of the report are close to your vehicle. In some cases the 2 or 3 vehicles won't even be the same year. They do compensate for this but it's not very accurate. CCC _can_, at the request of the insurance company, expand their search area if the vehicle's listed are not very close to the vehicle in question. If asked, CCC will also manually review the information in their report. The adjuster handling the total loss may not even know that this can be done.

What I mean by asking price and value being different is that everyone lists a price when selling a vehicle. How many times do you think people actually pay that price? Almost never. The _selling_ price is almost always lower... especially in todays climate.

But again, CCC reports can be horribly incorrect as the information they are provide can easily be incorrect.
