how would i get the insurance information from a person

she didnt have the insurance information on her at the time of the wreck but told me who she was insured with i have her name address and telephone number so how would i get it cause she wont answer the phone when i call

Translation.... she does not have insurance on the vehicle. Right from this point I can tell you that this is the case.

At this point you should have contacted the police as it's _illegal_ not to have proof of insurance and it's _illegal_ not to exchange this info at the time of an accident.

What to know why she is not answering? See my statement above.

So far you have let this person walk all over you. So far you have buried yourself in a hole that you now must work out of.

My recommendation is to file a police report at this time and let the police know that this person had no proof of insurance and is not answering your call.

Keep in mind that you now only have your statement that this person was even in an accident. If they deny that they were in the accident what proof or even indication do you have to show that you are telling the truth?

Do you have a cell phone? If yes, why would you not take a picture of their vehicle and them and/or their drivers license at the time of the accident?

Do you have collision coverage on your policy? If yes, you may want to file a claim under your policy and have your carrier attempt recovery.

Once you have filed a police report you may want to contact the DMV to see if they will give you this person's last known carrier information. Some will, some won't. But int he end, I'll say that there is a 99.99999% chance they don't have valid insurance anyway. That percentage is probably a little low.

What would be the right approach for the OP under such circumstances? The other party didn't have the proof of insurance right at that point of time. I agree that not having insurance proof is illegal. The OP could have taken a few snaps, but is that all one is supposed to do? (What would you do if the same incident occurs at a place where there's no policemen around?)

Call the police and let them know you've been in an accident with someone that does not have proof of insurance. The police should respond and issue a citation to the person for this infraction. That person then needs to go to court over the citation. The OP can be there as well and ask the judge to make a condition of paying for the damage. I think (somehow) in some states the state will automatically suspend the person's drivers license until they can show that they have paid for the other person's loss. Keep in mind... a person needs to have "financial responsibility". Almost always this is active insurance. But not having insurance does not eliminate the need to be "financially responsible" for another person's loss.

As it stands now, what is stopping the other person from claiming that they were not even there? I'm hoping the OP has something like a drivers license number... something that the other person would not give out unless they were in an accident, but if it's only a phone number/name/address, then again, there is nothing to prove that the other person was even in an accident. Photos of the two vehicles together, photos of the other person there, photos of the person holding their drivers license... all of this goes a long way in preventing the other person for telling lies. Keep in mind... this is someone who does not mind driving around without insurance. How trustworthy would they be.
