Paying PIP recovery

Thought I'd post this here as it's mainly auto related...

Today I see an adjuster who paid PIP subro to another carrier before the BI was settled. The adjuster also wanted a PD (auto) release from the claimant before it would be paid.

I've never see this done nor would I ever do this. I've _always_ obtained a BI release _before_ issuing any payment on PIP subrogation. After all, it's still from the BI coverage.

Also, unless there was some complication with PD I never obtain a release. I know that some carriers do... but I'd say not most. When I asked the adjuster why they wanted a release on PD, they said because they did not want the claimant coming back for more PD. I'm thinking... if it's owed, it's owed. But then I'm also thinking... well, you did not see too concerned about this happening on the BI!

I'm I missing something here? Would you (have you) ever issue payment on PIP recovery without a BI release from the claimant?

I have never seen this before either. BI is and has always been first, everything else second. I would never issue payment without a BI release.

I have encountered this before, but it's only once in a blue moon and the reason is just like you said; so they don't come back for more. But it's not with much regularity.

Thank you! I was second guessing myself for while. Plus I just started there so I did not want to ruffle any feathers. Holding up a PD claim for a release is a sure way to keep a high pending.
