I am upside down financial in my car. I am unable to get in touch with the other persons' insurance company.

Yes, if it turns my car is totaled, can I request medpay rom my auto ins. company even if I was not hurt in this accident, nor was I in the car at the time of the accident? I will need the money to buy another car.

Sure, go right ahead and make that fraudulent claim. Then you'll have the next five years all to yourself while sitting in your state prison cell after being convicted of INSURANCE FRAUD -- you won't need a car at all.

Plenty of time to save the money needed to buy a car when you get out. But at prison wages of about $0.20 per hour, you won't be buying a Mercedes. Come to think of it, you won't be buying much of anything.

When it comes to auto insurance fraud, many people have tried all sorts of things they thought were "clever" and would never be noticed -- and they were caught, charged, and convicted -- it's the #1 form of insurance fraud, so everyone is looking more closely at the claims than most people realize. Your idea is about the dumbest one someone might try. If the vehicle was parked, and you weren't even inside it, how could you possibly have been injured? Just because you failed to purchase "GAP" (Guaranteed Automobile Protection) is no reason to make things worse for yourself by trying to get additional money from the insurance company to solve your financial dilemma.

Merely submitting a false claim, at a minimum, involves PERJURY, another felonious crime for which you may be convicted and sent to state prison -- even if fraud cannot be proved. But making a claim for reimbursement for medical expenses when, in fact, there were none, is clearly something being DONE WITH INTENT TO COLLECT ON A FALSE CLAIM -- the necessary element of fraud.

So, no, in all sincerity, please don't even attempt to file such a claim.

I had no plans on doing anythink wrong, I was told by someone that I could file for medpay after an accidednt. Why do yo think I was seeking advice, if I had my mind made up your advice sure would change it and I would not need to ask for advice.

Some people honeslty have never been in certain situations or don't know the rules and need sound advice. If you sounded off on everyone like you did me, I don't why anyone would be coming to this site for FREE ADVICE. After an accident any type of accident and given all the emotions, no one wants to me spoken to in this manner. I certainly don't want to. In the future I will seek advice some place else. Thanks for your FREE, HUMILIATING ADVICE.

I was not implying that it was your intent, just being a little sarcastic. You came for advice and received it. I did not intend to humiliate you, and if you feel that way, please accept my apology.

But consider what would have happened if you simply followed the advice of the person who planted the idea in your mind. You have, I hope, an agent with whom you can speak about this. Why not give that person a chance to answer your question?
