My body shop would not take more than my deductible of
$ 500 and the same day I picked up my car I deposited my insurance check. They stated that they were going to bill the insurance company when I picked up my car. The check cleared and now I have 4600 in my bank account,.. Should I wait until my insurance company bills me?

How it works.... your insurance company issues payment to you, less your deductible amount (if there is no lien). You then pay the shop the full cost of the repairs. Since you were paid for everything but the deductible, you are only out your deductible. If the shop did not collect full payment from you and allowed you to pick up the vehicle then they are dumb or confused. It sounds to me like they think (for some reason) that the insurance company has not issued payment and as such, they are going to have the insurance company issue payment to them. I think at some point you are going to get a call from the body shop looking for the rest of what is owed. How you want to address this is up to you. I'm hoping that insurance check was payable just to you and did not have anyone else's name on it. If it did, it may be reversed at some point.

Trust me... your insurance company is not going to issue payment, just to collect it all back later. No sense in that whatsoever.

Hi I have a question regarding your last response. The body shop just notified be that they want their money. I took your advice and went to the Jaguar dealership and was told that the broke my headlight when they installed it, thus requiring a $ 1,400 in repairs. I was told my adjuster to get my car fixed and subtract the total out the check the insurance check plus my $ 500.00 deductable.
My concern is that they will want to issue a lien on my car after the 30 days. I find it interesting that it was exactly 30 days after I picked up my car they are wanting their money that they refused to collect when I picked up my car.. You suggestions would be greatly appreciated.

Did they actually state any reason for their not collecting it 30 days back? Did they express any intention of issuing a lien so far?

I am confused. The shop told you they damaged the headlamp and is/did bill you for the $1400 to replace it? They should have collected the total amount of the bill when you picked up your vehicle including your deductible like T stated. Why they waited for 30 days is beyond me. If you have deposited the insurance check as you say, pay the bill and you won't have to worry about the lien.
