My car was totaled but I want to drive it until we settle

My car was recently totaled by another driver who failed to yield- however it is still drivable. I allowed it to be towed from the accident because the bumper was coming off and the headlight had been busted and the front was pretty beat up. But they are wanting to total my car for far less than what it is worth. I tried to settle with them at $400 even though my car is worth $2000 more, but they do not want to settle so now I am taking them to court to get the value of my car. But in the meantime I have a newborn and no car as I can not afford a rental car right now. Don't I still own the car as we have not come to an agreement on the settlement - so therefore can't I get my car and continue driving it until we come to a settlement and then they can have the car? I just need something so that I am not stranded without a car while I wait for the whole court procedure to be over.

Yes, you can do that. But they may hold you responsible for getting the car back to where it's located now (and/or the salvage company). If the bumper is not affixed correctly you may be issued a citation from the police. It just depends.

Hope the whole court procedure to be over soon so your newborn can enjoy the ride . I have been in that situation before and its little bit annoying. Insurance companies will tend to give you lower amount thinking your car is priceless

Some times the damages are deeper than they seem from outside. So you'd definitely need to be careful. A citation from the police can make your situation worse.
