Can I sue my Title & Insurance Co.?

i recently decided to do a short sale on my home, however i found out that i am only part-owner of the property; turns out that the siblings of my late husbands own the other half. I did a refinance a couple of years ago, and in that process i had a title and insurance do a title search and the issue never came up. Can i sue my title and insurance company for bad faith?

No you cannot sue the Title Company for "bad faith". You can file a claim for failure to provide proper evidence of clear title. That's exactly what the title insurance is for.
