Rear-ended while driving on a suspended license in Missouri.

The other party has accepted fault. My car is fixed & I have been in in physical therapy for back pain & migraines for 4 months now. No serious injuries. I have a lawyer & he said it will be difficult getting a proper settlement.

Med bills $15K, car damage $4K, loss wages $400. Considering my attorney does not have faith in my case due to my license status is obtaining a settlement of $50K achievable from Farmers insurance?

I know I wasn't suppose to be driving--didn't know then, but I had full coverage. Should we seek pain & suffering or give up?

I don't think so. Regardless of your suspended license, your compensatory damages, not considering pain and suffering, is 20k.

You expect another 30k for pain and suffering when you were not seriously injured? I think you would be lucky to get $2000 for pain and suffering, but expecting a total of 50k for settlement is unrealistic.

WOW!! Lots of damage there..for you and your vehicle. But,(I suppose this is on a 'personal note') I have a 'pet peeve' of hearing that people, who have a suspended DL are driving. I AM sorry to hear you were hurt in the accident...but......th accident would have never happened if your were not driving, correct? I've heard people say, who have lost their DL for a short amount of time or permently say "you have to do what you have to do." I don't agree!! People loose their DL's for a reason!! I'm not trying to be hateful....just stating a fact.

I agree. I heard of a claim where a person driving uninsured was rear-ended, but they were considered at fault because the uninsured driver should not have been on the road in the first place. This would depend on state law, and not typical.

Unfortunately, a lot of people do "do what they have to do." If they have a suspended license, and the only way to get to work is to drive, they do it.

This is why uninsured motorist coverage is so important. The most dangerous drivers on the road either don't have insurance, or have minimum coverage. You need to protect yourself and your family from these people.

I'm glad I've never been in a situation where I've lost my DL for ANY reason. As I (believe?) stated above, people lose it for a reason. I had a neighbor of mine ask if she could drive my car (sounded strange because she had a car of her own). I kept asking her what was wrong ith HER car that she couldn't drive it. She never answered me and just walked away in a 'huff'. Too make along story short, I found out she didn't have a DL and the police, in the area where I live (and it's a very small community..) were "keeping an eye out" for her car. I can't believe she would put me in a 'position' like that!!

That doesn't make it right, and, in California, it would 100% exclude any legal action on the part of the uninsured person to recover any damages other than actual -- NOTHING for pain and suffering -- with or without an attorney.

WOW, MAX!!!!!!!!!!!!! As you know, I'm originally from California. Nope..didn't know they were THAT strict with the 'suspended DL' thing. Good..I'm glad they have that!! Seems sometimes, people just get away with it time after time after time. California is getting much stricter with ALOT of laws lately.
