The insurance company can pay for $100,000 in repairs to a $13,000 if state law will allow it. Most states require a carrier to total out a vehicle when it's repair cost is 80% of it's value. I don't know about your state. You can certain file a complaint with your state Dept Of Ins and mention this.
Have you spoken to the adjuster about this situation? You don't mention that you have.
