All State paid the claim both to us and the mortgage holder, the mortgage co holding reimbursing the check, what is the california law on paying such service it is 3 months old,

The insurance company has a legal duty to protect the mort. companies interest in the home. It's granted by state law and it's probably mentioned in the policy.
