Your post is rambling and hard to follow. Who owns the vehicle in which the "driver" and "passenger" were riding? Assuming you are the "passenger" of the discussion, your damages are the result of a third party driver or the driver of the vehicle in which you were an occupant. If the vehicle's owner permitted the vehicle to be driven by an excluded driver, you might have a personal claim against the owner, but that is remote.
Sounds like you may end up being a big loser for riding in an uninsured vehicle that collided with another uninsured vehicle.
