Illegal alien hit my car

I got rear ended by a Chevy three days ago. My Mini is crunched, the right side door needs to be jerked open, the bumper fell off and there is an 8inch crack on the boot and a shattered rear windshield. The driver tried to pull away, hit and run and messed up the paintjob on the lower right door panel and also ripped off the side mirror. The officer on spot did not arrest anyone, no ticket either, only filled out “driver exchange of information” form. I called my insurance company and they said they will look into it. They call back the next morning and asked for my copy of the form the officer filled out. I took it to them and a few hours later they tell me that there is a problem because the driver of the other car is an illegal alien without insurance or valid papers. I have collision, comp, BI and uninsured but the insurance company is telling me that they need fifteen days to 'process' my claim since this is a special case. Why would they need so much time? I have always paid my premiums on time and I have a clean driving record.

I'm guessing that the 15 days is because they are you have UMPD (not just UMBI?). If this is correct then they want to pay your loss under UMPD instead of your collision coverage. Perhaps they need some time to confirm the other person has no insurance. If you don't have a deductible under UMPD then you might not mind waiting. Of course, they could also pay your claim under collision coverage now and after 15 days simply forward you your deductible is the above info is correct.

When they told you of the 15 day wait did you ask why? I'd recommend you ask them about this.

If they are paying this under you collision coverage then they don't need 15 days. What your policy states is the coverage you have... they don't need 15 days to figure that out.

As tcope said, you need to find out why your carrier is asking for a 15 days waiting period. It might be that your insurance company is looking to verify the identity as well as the legal status of the person, whether or not he is an illegal immigrant or not. Whatever the case may be, you need to find out if your carrier is paying you under UMPD or collision coverage.
