Not at fault but Insurance refusing to settle in full

I was in an accident in which the person on my right sped up and got in front of me while we were both about to make a right turn. I had the right of way and the other person also admitted to being completely at fault since he was distracted. I have a copy of the police report which back up my claim. I filed the claim with his insurance company and a couple of days later I was told that they would cover only 70% of the cost since I was the one who had struck his car. I think it’s a little unfair. Is there any way to address the situation?

You may want to give some more info on the loss. The other person was in front of you and you both made a right turn... care to explain _why_ the two vehicles collided?

This guy was behind me, on the left side and suddenly he swerved right, got on my side, sped up and tried taking the turn. He gave no indications that he was going to take the turn. By the way he sped up, I thought he was going to go straight down the road.

In my opinion, its not your fault. You had the right of way and the other person cut you off while making the turn. You should be covered in full I think.
