No, they wouldn't sue you for not having insurance. They would sue you if you can't pay them for the damage you caused. If you can settle their bill out-of-pocket (which I don't think you can) they shouldn't have any problem. It doesn't matter who hit who. You have been cited as the at-fault party. Yes, an attorney would be more expensive than filing a claim. It all depends on the other party now.

It doesn't cost money to raise a bill against you so yes, they can hand you the repair bill knowing full well you can't pay up. On the other hand, taking you to court over a broken tail light will cost them some. And if you are taken to court you will of course be charged for driving without insurance.

Yes they already cited me for court for not having insurence but... the police officer told me that there was a chance the other party wouldn't charge me because like it was a company car there insurence would go up for all the cars they have and it wouldn't be worth it over a broken light do u think that's true?

If that one single car is covered by a policy insuring all the cars in the company fleet, there is a good chance that they won't bill you for the busted tail light and the dented bumper. They'd rather claim it under their own UM coverage if they have it. Their premium is going to go up anyway in case they make a claim.

Then why are you driving around town? Take the bus.

On the other hand, taking you to court over a broken tail light will cost them some. And if you are taken to court you will of course be charged for driving without insurance

Another inept post by Heller. Going to court on a damage claim is a TORT offense, and is tried in CIVIL court. Driving without insurance is a TRAFFIC offense and is tried in CRIMINAL COURT. The civil court judge has no authority to charge anyone with a criminal/traffic offense.

Will the OP be sued? Probably not. As has been said, it's probably less costly to either repair the damage and not submit an insurance claim, or submit it under Uninsured Motortist coverage, since that was the case.

So he won't be charged for driving without insurance at all?
