Is agent responsible?

Had ins. comp. asking for pictures. Sent to agent and they did not send to insurance company. We got dropped so mortgage company put us on ins. which with escrow our house payments went up $108 a month costing us around $1100. We were under the ins. from mortgage company for 52 days.

First... I doubt all of that happens quickly. Your insurance company would have sent you a notice that the policy was being cancelled and, most likely, your mortgage company would have informed you of the force placed insurance.

Have you spoken to you agent about this error? It's certainly one of the first calls I would have made.

I completely agree with tcope.

Yes, the agent is responsible, since he didn’t send the pictures to your insurance company. You can call him up and later on, if things don’t work out, drag him to the court for his negligence. However, there must be other reasons for which your insurance company dropped coverage.

If the insurance company asked you to submit photos, why would you send them to the agent and not the insurance company? The agent is not the insurance company.

As tcope has said, call the agent to discuss the situation. I would add: let him know you are planning to make a claim against his E&O policy and you want the name and phone number of his insurance company. That should get his attention.
