AUTO INSURACE CLAIM DENIAL ON THEFT

MY INSURANCECOMPANYIS DENYING TOTAL LOSS DUE TO CAR THEFT
FOR REPORTING CLAIM 30 DAYS AFTER THEFT. I REPORTED TO POLICE IMMEDIATELY THEN FILED LATE DUE TO LOCATING PAPER WORK. DO I HAVE LEGAL GROUNDS TO SUE FOR LOSS UNDER COMPREHENSIVE PROVISIONS OF AUTO POLICY.

Read your policy... and the _written_ denial. Does your policy state that you have report all thefts within 30 days? I kind of doubt it. Does it state, as soon as possible? Probably. I think you need to mention _exactly_ what the denial is for.

PS I have no idea why you'd need to find "paperwork" in order to report the loss to your carrier. I then have no idea why it would take 30 days to find said "paperwork".

When you reported car theft to the police immediately, I’m surprised why your insurance company is denying your claim. Please check your policy to find out whether you’re suppose to report all theft within 30 days.

Insurance companies are entitled to notice of a claim within a reasonable period of time. Health insurance, for example, generally expects that the insurer will be notified of a claim within 20 days, but makes allowance for reasonable delays.

An auto policy might specify that claims are expected to be presented within 30 days, but the insurer must still make allowance for a reasonable delay.

I am not convinced that "locating paperwork" is in the category of a reasonable delay. What paperwork would be necessary to report the theft of the vehicle the same day or the next day following the incident? You cannot supply paperwork over the phone.

If the policy says notice must be given within 30 days, and notice was not given, then I would side with the insurance company on this one.

hi my car was stolen 4 weeks ago.....the police found the car 2 weeks ago i went to pickup the car because geico personal ask me to pickup the car my self because the car is under my name....all the inside is broken and looks like some one use my car as a restroom...smells very bad....the problem is the adjuster didn't want to make the car total loss because the repair cost is going to be like $19.000 and the price of the car is $32.000 ...now the problem is that i just received a call from the dealer where my car is being repair....in order to start working on my car we need to wait from 60 to 90 days in order to get the parts for my cay....i owen a nissan quest 2012 my question is there is a way for me to make geico made my car total so i can go and buy a new car ???

You cannot force the insurance company to do what they are not required to do under state law.

If you ask nicely, may they will respond appropriately to the following request:

"You know, in the spirit of the Christmas season, and because I'm going to be without my car until sometime next year, could you please pay for a $20-$30 per day compact rental car for me until my car is repaired?"


With any luck, they will say yes to that. When it comes to customer service, I've always found GEICO to be a pretty good company.
