Drunk driver/settlement

My 8yr old daughter and myself were hit head on by a drunk driver. My car had around 6000.00 in damages. We were both transported to the hospital by ambulance and I have 2500.00 in medical bills from a blod clot in wrist from accident. My daughter has 4500.00 medical bills from facial contusions and cuts and soft tissue strain in back. I have about 1000.00 in expenses from mileage and time off from work for doctor appointments. This all happened over Thanksgiving holidays and I was unable to cook and do several family traditions during that time. My daughter who has perfect attendance at school since kindergarten missed school was unable to play in her softball tournament and our church Xmas play. I am asking for $7000.00 pain and suffering for myself and $14000.00 for my daughter. My question is does this sound like a reasonable amount and will his policy limit classify us together as one claim amount or will each of us be seperated to reach the max limit for each of us?

It does not sound unreasonable. Usually a personal lines policy will have a per person limit and a per accident limit. The per accident limit is usually twice the per person amount.

Which state are you in?
The bodily injury liability covers for the pain and suffering.

Each of you would be treated separately according to the per person limit, and your claim amount seems to be well within the minimum state specified requirements.

We were just hit by a drunk driver as well. In our state we can also ask for punitive damages. Of course we are capped at whatever his liability limit is. Check to see if your state allows punitive damages for drunk drivers.
