Was involves in a head on collision in Utah of 2006 had a 2002 Toyota Tacoma I had made 2 years if payments to bank of America they were the lueholder in 2006 I was UN the accident not at fault I had full coverage on the truck the other Guy at fault was double covered long story short I believe the attorney in Washington that I hired git payment from the at fault diver never paid me! My insurance farmers made 2 checks one for me and one for Mr and the bank of America! Who pays the bank of America and if bank of America got paid 2 one check for 10730.00 from farmers also I made 2 years of payments at 315.00 and I beloved the Stormer paid bank 22000.00 but the bank says their is no more record of the truck or the payments please help I live in Oregon attorney I had Washington and accident in Utah!

Well, you/your child posted most of this in another thread. Similar problems with spelling.

Why is this suddenly a problem more than six years after the fact? You paid an attorney to handle your matter, if you have questions, you need to ask your attorney. That's what you paid him for.

Why does everyone always ask why this is a problem now! Herself the bottom line their was some mispelling my mom and dad don't speak English or read or write it they are from Mexico with nothing more than a third grade level! I their son was finally able to look at the documents! P.s you never answered my worries or gave me ur input! I thought this was a helpful place. Thanks anyway maybe someone can answer me! The other issue is that I'm _sure_ there is much more to this then mentioned. For the past 6 years no one has been paying on the loan and Bank of America has never once said anything about that? Why do I think that is not the case.

The only reason a carrier would pay a bank is if the vehicle were a total loss. If they paid the bank with one check and "Mr" with another then they would have sent the bank check right to the bank.

As mentioned above... your post makes no sense on so many levels.

My only recommendation is that someone call the insurance company and ask for a copy of the cashed check. If it's someone else then you may want to file a fraud claim with the bank.

As I reread your post is looks like you are saying "you" never got the check that was sent to "you". If this is correct, as mentioned above, obtain a copy of the cashed check from the insurance company and see who cashed it. If it's not the person it's made payable to, see if the bank will accept a fraud claim. You are most likely going to get little cooperation at this point as someone waited _6_ years to do anything about this. I don't know if it applies but the Statute of Repose in UT is 6 years. So you may not be able to pursue a fraud claim at this time.
