I presume the OP is asking whether the insurer for third party auto insurance, covers losses if the number of passengers is more than the vehicle has legal permission to carry.

The insurer may deny coverage in such cases. They may not pay for accident, loss, damage, injury or legal responsibility if the number of people including the driver exceeds the legal seating capacity of the vehicle.

Makes only a little sense. Liability is the negligent party's responsibility. How does carrying too many passengers cause a negligent third party to have a collision?

Even under a theory of contributory negligence, this would be hard to prove.

The real problem is a person's liability coverage would probably be insufficient to cover all the claims. And that may be what the post was about. Who pays the uncovered losses?

Which is where the issue of overcapacity could be problematic. But until the OP returns -- which is less than likely -- we may never know.
