In ky.. i rear ended a woman . called police.. no injury.. minor damage..like less than my deductible. we decided that if it was less i would pay out of pocket.. i tried for weeks to get her to send pictures, info about car make/model, color and to set up a repair time.. she replied with small talk.. then i sent my last message begging to get this handled because the stress was making me sick.. no reply.. for two months. this morning she sent a text saying that she wants it done now and that her insurance co. has a 1200 estimate for a bumper cover! my issue is... what if she backed into a pole or a ditch. I grew up in body shops and repair shops so i understand that they go to the dealer but I get the feeling that something else has happened..

There is a time limit... the time limit is the amount of time she has to file suit against you. In KY this is 2 years.

First, your deductible does not apply to damage to others people's vehicles. Second, if you choose to address the loss yourself, then the hardship that goes along with it is on you. If she wants to wait, that is her right. If she wants to tell you it's $1200, that is her right. You are welcome to review her estimate and inspect the damage to her vehicle. You are welcome to attempt to settle for less. But expect some grief from your insurance company if you do all this and then report it to them to address.

Yes, of course there's a specific time limit involved and in your case it should be 2 years.

Your insurance contract generally has a provision in it that requires that you not create a situation that could result in legal liability on the part of your insurance company, such as agreeing to make a payment for damages, and then not paying. Or, in your case, agreeing to pay an unspecified amount and then balking at the amount. You should never have agreed to pay anything until you knew how much it would be. Live and learn.

As tcope has said, your deductible is not involved in the damages to a third party.
