Back and neck pains whiplash. Plus severe sprained ankle had wear brace.two weeks. Concussion. Er visit wax at 12000 not counting two follow up visits our medcine .lostvwages.of.around.3000 to 4000 what be.average settlement . I wad passenger in truck driver lost control trying miss deer hit embankment head on at about 40 to 50 mph

You are entitled to recover 100% of your actual damages (medical expenses, lost wages) not already paid by other insurance. As for "pain and suffering" -- no one can tell you what that's worth, although an attorney will tell you "millions of dollars" in order to get you to give him 30% - 50% of your total settlement (including the actual damages),

A general rule of thumb to which most insurance companies will easily agree is 2x to 3x the amount of actual damages. It's not a formula, and it's not a law. It's simply an easy number to calculate and pay. If you don't think it's adequate, you can ask for more, or give up 30%+ to an attorney to ask for you.

In some cases, even those expenses. In some cases they are owed back to some carriers (such as health providers) and in other cases they are not owed back (such as to a PIP provider). Some states allow double dipping.
