Car accident by my girlfriend's son

I had a car that was not working. I kept the car parked and waited for the title to be sent in my mail to get rid of it. There was another car that i drove. I did not insure the parked car and neither drove it at any point of time. However, one day my girlfriend's son drove the car to check out if it was working properly or not, while i was at work. Unfortunately, he met with an accident and i believe it to be his fault. he paid off the no insurance ticket issued to him. Now my they got my license cancelled for a year because of the incident. The insurer of the other driver has filed a lawsuit. Only i was the person who received the papers and not my girlfriend's son. My question is only i will be liable to pay the insurance company? how does this entire process work?

Did you file an Answer to the lawsuit or let it go into Default? Do they now have a judgment against you? If not, you may want to pay an attorney a few hundred dollars to review your situation.

Also, was your girlfriends son named as well? If so, is he willing to pay for the damage that he caused?

If the damages are something that you can pay for then you may want to call the attorney for the other person's insurance company and see if you can work something out. Point out the obvious... that you don't have any assets so a judgment is going to be hard to collect. See if they will take less then their demand in order to settle. However, if this has already gone to the point of a judgment then 1) they have probably added in a lot of their costs/fees and perhaps other charges which were not owed and 2) they may just feel like leaving the judgment and trying to collect on it. If you let it go into default and a judgment then you are in a worse situation. If you had dealt with this situation when it was just the insurance company asking for payment then it's very likely that you could have worked out a deal to make payments for a reduced amount.

If you continue to ignore this situation as you have, it's only going to get worse.

What about the girlfriend, is she going to pay for her son's actions? What about the son? He is he one that should be paying for all of this.
