Was forced to hit a tree and now insurance blaming me..

I got into an accident last night at about 10pm. A blue mustang that passed over me so speedily and in the process came so close that I lost control of my vehicle, drove off the road and hit a tree. The mustang fled the scene.
I called my insurance company right there and within moments and made a claim. The police never got into that place so there is no police report (just eyewitnesses of two tow trucks).

This morning a lady called me and asked the same question - how the incident took place. I just uttered the same stuffs. But this time she started blaming me for the incident as the mustang didn’t hit my car. When I repeatedly started conveying my situation, she ceased the communication.

She has already sent me an email stating that I was at fault. I don’t understand, if I’m paying for full coverage why do they still want to blame it on me?? I just want to know if I’m at blame will they still compensate me, since I have full coverage and the other car hit and run. I do have collision and comprehension.

I'd covered under your collision coverage, at fault or not. The thing you need to watch if if your rates go up because they have you at fault. Did they speak to the two witnesses? If not, I'd send them a certified letter pointing out that you were not at fault and giving them the witness information to confirm the other driver caused the accident.

Perhaps they have used all of the information and come to the conclusion that you were at fault. Personally, I'd probably error on giving you a the benefit of the doubt but it's their call... they have more details them you've posted here. My recommendation is to keep pointing out that the reason there was no contact was only because you swerved and this is why you hit the tree. Otherwise you would have struck the other vehicle.

The adjuster is simply giving you their first opinion based on the information you provided. How could they conform to you when you have no evidence, no police report apart from the description that a phantom car almost hit your vehicle and, which forced you to collide with a tree?

Nowadays, insurance fraud is unrestrained and therefore, they ought to be suspicious of your story to prevent any potential insurance fraud. Due to increased insurance fraud, now adjusters, agents, underwriters and everyone else in the business are trained to be suspicious.

I guess your claim is not settled yet and therefore don’t jump to any faulty conclusions. No adjuster has inspected your vehicle yet and no offer or conclusion has been made. You are just in the initial stage of the claim. So don’t worry.

It doesn't matter what you are paying for or how long you been paying for it. The simple fact is that there is no evidence that anyone other than you is at fault.

Your claim is going to be paid by your insurance company. That's what you are paying for when you purchase collision coverage -- damage you do to yourself. If your vehicle is a total loss, you will get Actual Cash Value which is Replacement Cost minus Depreciation.

I don't know why you are calling this "hit and run" -- there was no collision between you and any other vehicle. Could someone have forced you off the road? Yes. But without witnesses, know one will ever know. The tow truck drivers are not "eyewitnesses" to the collision between your vehicle and the tree unless they were actually there at the moment it happened. Otherwise, all they can "testify" to is, "Did the lady's car collide with a tree?"

I do have collision and comprehension.
