pothole at night it did damage to my transmission they refuse to fix it say they cant see damage. I ay 768 dollars every 6mth. they only paid towing.an 3weeks rental. my wife is disabled.an they gave me an the mechanic a very hard time an claims adjuster very nasty over the phone. its been three weeks dealing with them what can I do

If they have denied the claim (most likely as wear and tear) you can feel free to file in small claims court against the insurance company. Be prepared to prove to the judge that the damage occurred when you hit the pot hole.

Your claim should have been made with the city/county/state agency that maintains the roadway. Normally, you must present those claims for damages within 6 months before you can sue the city/county/state agency.
