Is my car totaled?

My Volkswagen Jetta was hit by a two ton truck hauling medical equipment. The guy driving the truck was just trying to overtake me and then suddenly came close and hit in the front. The left front wheel has been crushed into the frame. The axle too is perhaps broken. Some of the front bumper is also bent and broken including the left headlight. The front door is also slightly off frame but I’m safe though suffered some minor injuries. I purchased the car in 2007 and as per KBB it is valued at about $12k. I have GAP coverage. Do you think the car will be treated as totaled? And will it be that guy’s insurance to pay for my deductible?

If the cost to repair is around 80% of it's value, yes. What is the repair cost... who knows.

I purchased the car in 2007 and as per KBB it is valued at about $12k


KBB does not show the market value of vehicles. Look at NADA for a correct value.

If the other person is at fault the other carrier will address your deductible. But you only have a deductible if you file with your own carrier and they seek recovery. Otherwise there is no deductible.

If your paid market value or close to market value on 2007 there is no reason you should be upside down on the loan and need GAP coverage. If you've been paying on the vehicle for 6 years and still owe more then a thousand dollars or so then something is wrong.

It's only the adjuster who is supposed to decide this and moreover, his say will be the last one. So let him decide..

If it was his fault, his insurance is supposed to pay for the loss. You insurance carrier only involve if his insurance doesn't pay enough.
