can i sue my old insurance company

Hello My husband and I live in New York and we had a policy with State Farm auto insurance that we canceled back in November 2014 because we sold the car . We paid for Novembers costs which we owed from my checking account and when we took over payments on a newer car we decided to go through another insurance company . Well come December State Farm took another payment from my checking account which threw my account into the negative and brought on a overdraft fee because my bank covered the $108.00 cost for insurance . Now the car was a 2000 dodge neon and we only had liability and now we have a 2007 vehicle that I pay $58 a month on for full coverage through another company . I have 2 part time jobs and my husband is out of work due to medical issues and is in the process of filing for social security disability so I am the only income in the household at this time . I live from week to week on my $165.00 combined paychecks and now because of their mistakes and refusal to put the money back into my checking account I cant cash my paychecks because I don't have the money to cover the now -$148.00 overdraft on my checking account and feed my kids , get to work, or pay any of my bills .

Did you send written notice to SF to tell them to cancel the policy the end of November? Have you spoken to them about this issue? Sometimes if you 1) show them that you no longer owned the vehicle or 2) that you have other insurance they will usually waive their fee. However, the charge from your bank is between you and your bank.

As tcope has said, it is a policyowner's responsibility to cancel coverage, especially when premiums are being paid automatically through a bank account. You can do this in writing, but you can also do it directly through most insurance company websites or by calling their Customer Service toll-free phone number.
