can i cash a insurance claim check from the at fault parties insurance that is made out to me in care of the auto body shop?

Nope, not unless the shop endorses it, but you can contact the adjuster and ask them to reiusse the draft to you only and you will either send that one back or distroy it. Since you are a third party claimant they can make the draft payable to you only.

cashing a check or draft with anothers name on it requires YOU to sign their name, in my part of the world we call that forgery and they tend to punish folks for that...and I assure you the body shop will be at the top of the list...because they will most likely be paying taxes on that amount.

Well, in any case you are required to pay the body shop what's due. I agree with lori, you can ask the insurance company to write the check on your name only. However, then too you have to send the amount payable to the body shop. You can't encash the check and keep the money.
However, if you have decided not to repair your car at the said body shop, you should then definitely request the insurance company to keep you as the only recipient of the check. You can choose another body shop to repair the car at a cheaper rate and can keep the excess amount if any.

insurances doesn't "in cash" they offered insurance because its a service...unless if they have a promo or something that offers you that you can in cash their insurance service.

Before you cash that check, consider whether you have signed a repair authorization or have a contract signed with a repair facility in which they began repairs based on that authorization, you'd best look at the wording of the contract or authorization. They may be entitled to administrative fees, storage, partial disassembly, loss of expectant wages, restock fee's for parts ordered, stall tie up fees, pre paid storage and tow, should you decide not to repair. They may have the legal right to file a lein on your vehicle should you decide to cash a check for repairs you authorized and later changed your mind.
