Sue your insurance company... for you wrecking your car? You could.... but you'd be wasting your time.

Read your insurance policy... what does it state they will do when you damage your vehicle? Are they doing this? If so, what are they doing wrong?

Unknown, your question is not clear...if the vehicle totals, they owe you the Actual Cash Value (ACV) of your vehicle, NOT what you owe...if that was your question...if you have GAP insurance that will pick up any balance with your lein holder...if as an example your vehicle is worth 10k you owe 3k, then they bank gets 3k you get 7k...on the flip side , vehicle worth 10k you owe 12k, your carrier pays the bank 10k and you're still on the hook for that 2k...if you have GAP it will pick up the 2k..to the bank...of course all of these payments would be less your deductible..

If you want further information please provide more information about your situation.
