Can my car insurance company deny my claim if I was not the driver and they were not on my policy? BTW...The other driver was at fault.

nmk,

If the other driver was at fault (and was insured), his own insurance should pay for it, and your insurance will not matter.

Otherwise, the answer is, "It depends." Did the driver live in your household, or did he drive it on a regular basis? ("Regular basis" is not always clearly defined, but a good rule of thumb is driving it more than once a month.) Most companies require you to list all household residence and regular operators on the policy, and failure to list him might be grounds for denial of the claim. This is especially true if he lived in your household or regularly operated your car at the time you filled out the application. If the application asked this question, and you answered "No," it is misrepresentation and might result in having the claim denied. (This varies by state law and by company.)

Second, do you have a "Named Operator Only" policy? Most polices allow you to let anybody you choose drive your car ("permissive use"), other than the restrictions above. There are a few policies, however, that cover only the named drivers. These are far less common, usually nonstandard, and many states do not allow them, so I will not go into any more detail unless you say this applies.

Hi Adriot!

Yes the insurance companies do preserve the right to deny your claim. Since you are in the process of getting your auto insurance, you must carefully read your policy documents and know what exactly the policy covers. Sometime it so happens that you make a claim for something that your policy does not cover. In that case, your insurer might deny your claim. Again, say you have uninsured coverage and made a claim in that, but it turned out that the other party at fault was insured, your insurer will deny your claim. Also if you make a claim that exceeds your policy limits your claim may be rejected.

Well, thought-out response, Christy.

Nmk, if the other driver is responsible for the damages, you need not worry about the future of your policy. The insurer might decide to drop the policy holder if he/she fails to comply with the clauses of the plan.

Now, if the driver was driving the vehicle with your expressed permission the insurer would cover the losses.

Thanks,
Rupert

"CAN" they? sure if they have reason, ''WILL'' they? doubtfull, unless the driver was excluded you're more than likely fine...

BTW...The other driver was at fault

If the at fault driver has coverage then your carrier won't matter...the at fault company will handle your claim.
