adjuster will not return my calls

My wife was recently hit from behind as she waited in traffic at a stop light. Her SUV is a total loss. I called the insurance company within the hour and they gave me a claim no. and said I would be contacted within 24 hrs. if not call back. Well, we have called back, left messages, asked for supervisor's and we get the same run around. The two times my wife did talk to the adjuster she hung up on her rudely. I work 40 miles from home and my wife needs a car to get to work and treatments for her injuries. What can we do?
It is Hallmark Insurance out of Plano, Tx.

Is this your insurance co or the other persons? If you want to go this route you could contact an attorney. This might not only help with dealing with your insurance co, but also dealing with the other at-fault persons insurance co. It usually takes time to sort these issues out so the insurance co might still be waiting for police reports and to hear from the other insurance co. However if this is your insurance co. and they were that rude to their paying customer than that is not acceptable

Have you given them anything in writing??? If not then please send them a email and thus you can record all the proceedings in the claim settlement.

In most of the cases person won't record any telephonic conversation.Rather directly approaching an attorney is not advisable at this moment, but what i suggest to you is that send them the claim form by an e-mail.Ask from them the time frame.

If they are still trying to shade their responsibilities then i will request you to take this case to the insurance commission of your state!!

Your agent, if you have one. shoul;d be able to help you. They should in no way be hinging up on you. I would ask for a supervisor and explain to them in a calm voice exactly what is going on. I alos am wondering if this is your own company or the other persons insurance. If it is yours they should be doing a lot more to assist you.
Do your have any coverage on your vehicle for rentals? Usually they will have to supply you with a vehicle within two days.
The other insurance company also can take a couple days to get everything in place. Let us know which insurance company you are speaking of.

Alan, is your wife talking with maybe an agent for Hallmark Insurance or the actual claims dept for this company...i can't imagine and adjuster hanging up rudely, i have however seen some employees of agents offices do this..I'm betting this isn't the claims dept.it appears to me that Hallmark is just a brokerage house and doesn't actually sell a policy under 'hallmark' you need to find out WHICH company this policy is written on. Either are unacceptable. I found this for their claims dept...well maybe they do it's hard to understand, but it appears the carrier has to report it to them.

you might try calling this number to see if the claim has been reported (not just to the agent)....do you have a policy number for the guy that hit your wife? Hope this helps...if you still have trouble (after calling these numbers and checking this site)...you can contact the dept of ins for texas, there are consumer assistance numbers there...i'm betting the actually carrier doesn't know about this claim..i could be wrong but that's what i'm betting...let us know how it's going and if we can assist you with anything else...there is no reason at all for your wife to be treated this way and yes they should have her in a rental until they make an offer of settlement (then only about 2-3-days max after an ''OFFER'') You also have the option of letting your carrier handle this (the vehicle damage) they will then subrogate the at fault carrier including your deductible.

Hi Alan - I'm sorry to hear about your wife's injury and trouble thereafter. I would not only contact a lawyer, but I would contact the Better Business Bureau as well. Lastly, I'm sure there's a record of who you first spoke to and your subsequent calls. I would call your insurance company back, demand to speak to a manager and have them investigate who has handled your claim thus far.

Written by someone who has no understanding of insurance. The Better Business Bureau has absolutely no power to force an insurance company to do anything.

If you believe an insurance company is not treating you according to the terms of your policy, you should seek free assistance through your state's Dept of Insurance (or the state agency that regulates insurance companies and agents) before seeking the services of an attorney.

You should write a letter, document all the times you have called and that no one has responded and demand that a person evaluates your claim and get back to you within a reasonable time. Send the letter certified mail to both the adjuster and his or her supervisor. If no one gets back to you within a period of time, then get yourself a lawyer and let them handle legal actions for you.
