I was hit head on by a driver who crossed over double lines

The man who hit me has no insurance and has nothing to his name for me to sue for my pain and suffering as well for my 2yr. toddler who to this day, 3 weeks later, is terrifed to get back into a car. I feel helpless because my medical bills are more than my coverage I have for myself through my car insurance. This man isnt having to pay for anything!! How can I ensure that I can at least get something for my pain and suffering or at least make this man suffer besides a stupid $100 fine for no insurance! I'm paying for everything as it is because I am responsible and have car insurance. There has to be some sort of victims law out here somewhere and I need major help, It will be a year before i can walk again and am always going to have problems with my ankle and knee. I am only 25yr. and have a 2yr. toddler to take care of. Please someone help me!

Where do you live. If in the states, the law can be different in each state.

Do you have UM (uninsured motorist) on your policy? Most states require this...if so then your medical bills AND pain and suffering can be paid under this coverage, your carrier will then go back to this jerk for reimbursement for the damage to your vehicle, your collision deductible and whatever they pay under your UM coverage...let us know your state, and check your policy for UM coverage, (it will be listed 'like' the BI coverage, ie 10/20-25/50)...has your adjuster not brought up UM coverage on your policy? Did you have medpay or PIP? that your carrier paid your medical bills under?

its really sorry to hear about this incidence.Nobody can actually get the full insurance claim when it comes to the suffering and pains.Insurance can only pay in monetary terms.

i indeed do have uninsured motorist for only $50,000.00 and i was in the hospital for 5 1/2 days and have already had 2 surgeries and have to undergo another one in May. The guy is no where to be found and all numbers and addresses are incorrect or not working. I believe he is from another country and has fled back to his orginal country. No one including the insurance companies can find him or get in touch with the guy. If i were to sue him for my pain and suffering for me as well as my toddler, i would end up paying more in attorney fees than actually getting anything from this piece of garbage. Isnt there some law or protection against people like this? it just doesnt seem fair that MY insurance comp. is paying for this and MY health insurance when it should be this guys responsiblity!! Is that the reward i get for being responsible adult and carrying insurance for medical as well as car insurance?!! I am so fed up that there is no law protecting victims like myself and others cause i'm sure this isnt the first time this has happened to someone. I live in the state of TN. :evil:

It could be one of the possibility, but it rarely happens with someone.Government does address any issue when it comes to mass public issue.Although this type of incidence can happen with anyone but I won't think there is any pool system for these kind of incidences from government point of view.

Hi, Yes im sick of people like that. As far as UM they should cover up to the 50k. As far as laws go i dont think there is anything out there for situations like this even though it happens alot. Who paid for the medical bills?

Sure there are but are of little effect especially if the guy has fled the country and likely an illegal to begin with..

Well there is a reward to it of sorts, had you not been responsible and insured you'd have to take care of your medical bills out of your own pocket..which would really suck...you have UM 50/100 that means each person injured (you and your child) can collect UP TO 50k each for this loss...(doesn't mean that you will get that, just that is the limit)..do you have more than one vehicle? If so what are the UM limits on it? Does your state allow UM stacking?

I total agree and understand your rant...been there, and rant about it daily, unfortunately in your case, dude has vanished...But fortunately you do have insurance...also you cannot suffer a rate increase for a UM claim...in cases like this I just HAVE to believe that karma (aka God) will get him...

Do libs not read the health care rroefm bill that is proposed? It clearly states within the first 20-25 pages that anyone who looses their insurance for any reason-miss payments, change jobs, anything-will BE REQUIRED to sign on with the government plan. That's not health care rroefm that's government control. By the way it won't be free it'll cost us a fortune in higher taxes, at a minimum.Yes, health care should be more affordable-no one in their right mind disagrees with that-but the government should not be the option. It won't be affordable,it will be a disaster. Medicare and Medicaid are current government health care systems and they are bankrupt and broken. How is giving the government another health care program/system going to work any better? If they failed so miserably with the responsibilities they've already taken why give them more responsibilities over more people's health care?References :
