"I was involved in an accident that caused me to go to the emergency room once, but I was in escruciaating pain several weeks after. I never returned to the doctor but The pain was almost unbearable at times. I was not in fault and the other driver's insurance company is trying to "Set aside" $2500 for my doctor bills and pay me only $500 in pain and suffering. I missed classes and even recieved a bad grade because of it that may hinder me from attending school in the future and I tol them $500 wasn't enough and my adjuster increased it to only $750. I feel that still isn't enough and im wondering how much of the total 3,000 I'm actually entitled to because the docotr bill is a littl over $900. What happens to the other money in my claim that I will not recieve. is this a scam??"

I would recommend that you hire an attorney. It might cost you but it will end in your favor. And you can claim the doctor's fees, attorney's fees and other charges. I would again advise you to check with an attorney as they would be more experienced in such cases.

Not a good idea (IMO) on a claim this small, you'll be giving up a min of a third...so that means if he gets you 1500, you get 1k...wait isn't that just 250 from what they've offered so far? .

It might cost you but it will end in your favor.

no no it won't it WILL end up in the attorneys favor however..

And you can claim the doctor's fees,

he's already being paid for them...

absolutely positively NOT...you cannot ask nor get attorney fees, your attorney is paid from YOUR settlement based on the contract you sign with the attorney...his fees are NOT separate, even if you went to trail...

. I'm sorry but in a claim this small not a good plan unless you don't mind giving up a 1/3 of a small claim..

And you saw NO reason to seek medical help? That just doesn't wash honey...I'm sorry but try and look at it objectively..

They aren't telling you that you'll get the 3k, they are saying they will pay the doc bill of 900.00 give you 750.00 and put 2500 in reserve for future medical expenses related to this accident for a specific time, (usually no more than 6 months)...now if you do not see the doc for this injury in that predetermined time frame, you do not get that 2500.00 it's just gone, and is for 'specials' (medical bills) only.

If you suffered a soft tissue injury and the ER visit was simply diagnostic, and you have sought no other treatment although in terrible pain...I think their offer is very fair..you might try and get 1k, but i'm betting they are at the near top of their range...

One other thing, how are you feeling now? Pain all gone?
