will my insurance premium go up because of a claim

I was driving on a major new york state roadway when I drove over something on the highway. this object was not big enough for the human eye could see while driving 60 mile per hour in a 65 mile zone. the object did not blow out the tire but did cause the rubber on my tire to shred. The shredding of my tire caused the body damage. I been with my insurance company for ten years with a clean record lest a speeding ticket I got six months ago. also, why is this considered a collision. Is not the definition of collision is two moving objects colliding? I Thank you for your indulgence.

I don't know who you have your Auto Insurance through, however,......some places do have that 'Accident Forgiveness' thing now. Also....some Insurance companies won't raise your claim if the accident is NOT your fault. Obviously..you din't do this intentionally.

simpson1w,

Normally yes, that would be the definition of collision. But in insurance, there is a slight variation. In insurance, collision doesn't necessarily involve two moving objects. The general rule of thumb to follow for most states (this may vary state to state due to statewide insurance regulation rather than national) is collision is colliding with any moving or stationary object. The normal exception to this is deer, which would be considered comprehensive. Since it seems your state has at-fault and non at-fault laws (some have no-fault), you would be considered at fault because you are the one who caused it (I know how much it sucks, but yeah...sometimes even I don't agree with insurance laws but I can't change them).

I hope this has shed some light on your predicament. If you have any other questions that I may be able to answer, feel free to ask.

Yep.......an accident, I was in, about 3 years ago.....................I went over 'Black Ice' (during the Winter), lost control of my vehicle, and went head on into a guradrail. THIS is considered colliding with something 'stationary.' However.....my rates din't go up because of it.
