insurance nightmare

we were in an accident last week going through an intersection a car blew through where a STOP sign was missing. he had a stop line in the street but since the stop sign was missing he didnt stop and totaled my car. The insurance company is saying we only have liability because its a new policy and we hadnt completed the photo inspection yet. The police report states I was not at fault, that other driver failed to yield to the intersection and that the stop sign was missing. I was not at fault, and technically the other driver would have been but the sign was MISSING. Now i have to pay 600 just to get my car out of storage and for towing. How can we fight this? where do we start?

Does the other driver not have insurance?
I don't understand why the missing stop sign has much to do with him being liable, especially since he was cited for failure to yield. (or so it seems you state that he was cited)
If the at-fault driver is insured I see no reason why you will not be compensated for your loss.

Sounds to me like your claim is against the city (maybe) or whomever is in charge of these stop signs. I can see that other guy has a great chance at beating his ticket, and escaping liability in this claim. How could he yield if there were no signs telling him to?

A couple of questions...

> What part of his car hit what part of yours?
> Did you also have a stop sign?
> Have you got a denial from the other guys company?
> How long did you have your policy, and why hadn't
you completed their request?
> Do you have a lein holder on your vehicle?
> Were there any witness?
> How long had this sign been missing and had it been
reported to the proper authority PRIOR to this
accident?

Were you informed by your insurer that you were driving with only Liability at the time you purchased the coverage for your car? Verbally or in writing?

Never heard of such a thing. People get insurance every day for cars and homes without them being inspected prior to the policy being written.

I agree Das, but there are a few captive agent carriers, that require this, especially on certain vehicles (ie prior totals, older vehicles etc)...personally I think it's a great idea, and back in the 'good old days' the first carrier I worked for (Shelter) routinely did this with new clients. (days prior to p.c.'s/laptops, and the www :wink:) -when people actually HAD to see an agent to buy insurance.

That's what I was leading up to.

I've been buying auto insurance for 41 Years and Never Nadda, Not once, ever, ever, have any of my Cars been inspected [before during or after] I applied for insurance coverage..!!

I suspect some Agent, Phone service, or Adjuster is offering a bit of Mis-Information to their Policy holder.

I could be wrong, and it wouldn't be the first time.

I would hope that this was explained to the insured when they purchased the policy. If not, they could have taken their business elsewhere.
