When the adjuster’s settlement offer is too low, how do i reply? The adjusters excuse is that the bills are above usually and customary charges. bills were about $6000, and the offer was for $7000 and then i counter offered for $11,000 then they came back with $8,000. what should i do or say now?

Well what is your argument? Do you have health ins or medpay on your policy that paid the bills? Does your state allow double dipping (being paid twice)..Have you tried to negotiate with the docs or whomever the bills are from? Has the adjuster only offered to pay your med bills only? No pain and suffering? What are the bills for, and what is your injury?

I do have med pay which covered $5000 of the bills and I have to pay the $1000. the bills are for a car accident that i had in december of 2008. the other person was at fault. my dx are neck pain and full back, lack of sleep cause of the pain. I sent them a demand letter demanding $15,000.00 for pain and suffering and for unpaid bills and for future treatment.

So you are wanting (basically) 14k for your pain and suffering? What was the diagnosis, and what are/were the treatments?

i would like a counter offer of $10,000 at least. the dx was neck, shoulder sprain/strain and upper and mid back sprain/strain. not able to sleep because of the pain and my work and regular activities have been limited becuase pain increases. i was receiving chiropractic/therapy treatment and i was attending a medical doctor for pain pills.

You can certainly counter with anything you'd like...I'd try to get that chiro to reduce his bill, I agree that sounds excessive. No health insurance?

I do have health insurance which only covers $25.00 per chiro visit.

No, I'm not saying that, just trying to understand all that 10 or 14k is going for..

Does/will your health provider subrogate or attach a lein on your b.i. claim for repayment? Have you heard anything from them about this?

If I'm understanding you correctly...You would be willing to settle for 10 or 11k right? and this includes your bills and the adjuster is at 8k now..is that correct?

there is no lien on my medical bills. and my part on my car insurance paid for $5000 of my medical bills (med pay!). and the adjuster is offering $8000 to settle. I think its too low?
