What do you mean they are paying off your loan? I assume you mean your vehicle was totaled is that correct? I also assume that since you say it wasn't your fault that the at fault carrier is handling your claim (allstate) correct? They should have had you in a rental car, until an offer of settlement was made. So you shouldn't have been walking all this time.

I need you to answer a few questions, we will be in a better position to help you then.

> What state are you in?
> When did they make you an offer of (total loss) settlement?
> Did you agree/accept with this offer?
> When was the last time you talked to the adjuster?
> I assume the papers you need to sign are POA's for the title?
> Has your lein holder provided the required paper work to the insurance company so they can pay it?

Typcially once an agreement of value for a total loss has been reached between the adjuster and the vehicle owner. The draft(s) should be issued within a couple of days, after they get whatever paper work they need.

> Has your lein holder provided the required paper work to the insurance company so they can pay it? i don't know, my insurance said they will handle it.

also my insurance told me being that i don't have the rental on my policy, they can give me a rental. they didn't take my car yet. i can drive it, but its at a risk b/c i have to tie the door shut. and on the other hand i can't find a car b4 they take mine away. every1 wants a big down payment.

If you are atty rep'd. then you cannot talk to the adjuster. Have your atty get in touch with the adjuster and see what the hold up is.
