Mopeds in Indiana are not Required to carry Insurance

A moped ran a yield sign and hit my car. He has no insurance. And my Full Coverage Insurance Policy is refusing to pay on un-insured motorist because a moped is not legally allowed on highways so they do not consider a 49cc moped a vehicle. I can sue the moped driver but he's already been sued and owes $30,000. Now I'm out the money to repair my car.
