Allstate - rearending question

I currently have allstate auto insurance with no additional policy (1 accident forgiven etc). I was rear ended last month and the case is likely to go into arbitration since the other party is trying to prove that it was my fault even though it was rear ending.

I have repaired the car and paid my deductible.

My current policy is coming for renewal on 15th Nov. So far the premium didnt increase.

Will it increase if the arbitration decides that i was at fault?If yes will it happen during my next renewal or the day the decision is made?

What will happen if i take the additional coverage now (1 accident forgiven with $100 reduced for deductible for accidents on the day of signing the coverage)? Will i get this benefit even though i have taken this coverage after the incident but before the arbitration decision?

How much will be the difference in amount/ year for this additional coverage?

How good is allstate in fighting my case with the arbitration committee?

Do you advise me to go for this coverage now?

I would like to take inputs from Any allstate people. (current or previously with them).

I live in california.

My child was backing up and another car was driving away and our car hit the other car. No police were called and no insurance information was exchanged. The other car left the scene of the accident and now wants us to pay for the repairs. Are we liable to pay if taken to court?

without knowing statements from both, its impossible to tell you for sure. typically the person backing has the responsibilty of making sure it's clear, usually at fault if they back into something. if both vehicles were backing, it can be found 50/50 and each are responsible for their own. also depends on your state laws regarding comparitive negligence.

Need to know if the other car was moving, which direction forward or backward, how fast, could they have avoided, points of impact, any witnesses? why wasnt the police called? private property i assume? were you there or going by your daughters account? what happened at the scene for the people to leave w/o exchanging info? how did they contact you w/o exchanging info?

how much damage are they claiming? $100, $200, $1000? i assume there are no injuries and just car damage? if you are at fault, is it worth filing or settling out of pocket to avoid a claim?

you need to report to your insurance company as soon as possible if you want them to help you....unless you want to settle on your own.

if you are indeed at fault, you are liable to pay if taken to court.
