Is it legal to accept money from doctor after insurances pay

Hello,

I have a question about double dipping in Arizona. I was in a care accident what was not my fault, in fact the man that hit me took total blame for everything. I just settled with his insurance company and most of that was sent to pay for my chiropractor and x-rays bills and the rest was sent to me. I also used $5000 on my insurance's med-pay that was paid during the treatment until it ran out. I did not know about double dipping until a front deks lady at the chiropractor's office confidently called me and told me that I should $5000 check coming my way from the chiropractor. She called because she told me that if people don't know about this law then he will double bill and then just pocket the extra money and she wanted me to get my money because it was such a large amount. So I'm pretty sure that Arizona does allow double dipping, I talked to a previous insurance adjustor and he confirmed this. My question is do I need to go to the chiropractor and get this money from him, or should I call my insurance company and see if they will cancel the original $5000 and then send the check to me? (The later option is what my insurance adjustor friend recommended should be done) Any help would be appreciated, thanks!

Some one I knew recommened him and this person had no problems with him at all.

I didn't think that this was okay for him to do, but until just a few days ago I had no idea that the insured could even do the double dipping.



Its the insured who is entitled for the double dipping. It allows him to collect both from his medapy and the other driver's insurance for the same damages, but not all states allow this to happen. In many cases the medpay payments are subrogable, i.e. the insured has to compensate his auto insurer for the medpay once he settles the injury claim with the responsible driver's insurer.

No Rupert you're right some (most) states allow double dipping if the insured has med pay...and med pay is subrogatible in most states as well...

i was in an auto accident and went to hospital cause i couldnt lift my arm or turn my neck.i didnt have any broken bones but it hurt. my health insurance paid all my bills.minus a few copayments i have uniinsured moterist insurance and they have offered me 5000.00 if i sign off they wont cover any more of my physical therapy bills because they said i my car wasnt hit hard enough for me to be hurt. they want me to sign off. since my bills are already paid do i have to pay the 5000.00 to my health insurance . i live in california.
