Well I got into a roll over accident and I'm 20 years old. I was the cause of the accident because something wasn't right with my car. My car was in my name and my insurance was up under a family's member name but we were removed from the insurance a couple months before the accident.

I was on a freeway doing about 73 and my car started shaking really bad to the point my steering wheel was going a totally opposite way then my car was. I was in the lane closer to the wall barrier on the freeway and i hit the car in the right lane after i hit that car, my car went spinning in a complete circle and I hit the wall on the freeway, after I hit that wall my call rolled over a good 3 to 4 times.

I was the only in the car with a seatbelt on, I had two passengers in the car with me and my 2nd passenger whom was in the back seat was thrown out of the back window. No one died but she was hurt. My family offered to pay all the medical bills of my passenger. Her family said more then likely her bills will be covered and I havent heard from her since she called a week after asking for my insurance info after she was told i didn't have any.

I'm just trying to find out what's the worst that could happen since I was the cause of the accident. It was another car involved, the car didn't have any demage that I noticed but I'm pretty sure he's going to try to sue me also. But I'm just a concerned teenager, Please Help!

Well at least one other car was damaged.

A person was through from your vehicle and your family offered to pay the medical bills? I don't know what this person's injuries are but a ride to the hospital/ER and an MRI is going to be about $3000. Follow up treatment could easily make this bull $5000.

You could/should be held responsible to make sure all of these parties are paid for their losses. If and how they pursue this is up to them... there is no way to know. it might not be financially worth it for them to collect on what you owe. They may all file suit against you and obtain judgments. Some states allow garnishment of wages to repay judgments. I'm not sure what information you are looking for.

Let me bottom line this for you... since you are only 20. You were driving a vehicle when you knew you did not have any insurance. You were not mechanically maintaining your vehicle. You did not require your passengers to wear their seat belts... which is probably another violation of the law. You caused injuries and property damage for which you can't make right (i.e. how would you like to have been seriously injured by someone else's fault and be left to pay those medical bills?). You are 20... consider this a "life lesson".

Why have you got yourself removed from the policy? And, why have you not got yourself a policy after being removed from the existing one? What has made you think that you can driver without coverage and never have to face its consequences?

Anyway, Tcope is right, you can get sued for the damages caused to the other parties. They can get a judgement against you and can eventually get your wage garnished.

Even if the other driver gets his damages covered under the uninsured motorist coverage, the insurer would seek recovery from you and would get your license revoked till you make the payments.

I read the substance of your inquiry and there are a couple things that come to mind. First, if the vehicle had any vehicle insurance on it whatsoever it would cover ever passenger in the vehicle under the liability or uninsured motorist part of the policy. You need to check with the insurance company to find out what type of insurance coverage is on it. This coverage is available regardless of whether you were on the policy. The person who own the insurance policy would have insurance on anyone that drive the vehicle. Second, you might want to consider having a mechanic determine why the vehicle was shaking. It could be that the front wheel was not on tight or it could be some other type of defect. If it was a manufacturer's defect that caused the accident, then you and every person in the vehicle might have a strict liability claim against the manufacturer and I would recommend contacting an attorney in your State that practice consumer law or product liability law.

Since you are at-fault here, you are liable for all the damages caused even if the accident was caused due to technical failure. Why haven't you thought of taking up a new policy when you are an owner of a vehicle? You will have to bear the expenses of all the damages whether or not they sue you.
