What can i do if the repair shop made repairs without author

I was rear ended and my car was not driveable. the insurance company towed it to to the place of my choice for the estimate, and i was told that i would have to sign authorization for it to get fixed. i found out there was damage to the "frame". therefore i decided to have if fixed at toyota. come to find out the repair shop has already did two days of work on it without me or the insurance company authorizing the work. with that said no one will work on the car since they have started work. what should i do in this situation. if i understand everything right, its against the law to do any work not authorized

No I believe he switched not too long afterwards. He was really upset because they had to keep taking the vehicle back because it would not steer right. I think it went back three or four times before he had to quit. He started having to pay so much towards it or something. I can not remmeber the full details I just know it was a real nightmare.

Did you sign anything before leaving the vehicle with them? A lot of repair shops will have you sign something allowing them to make any changes and add any repairs they feel needed to get your vehicle back the way it is suppose to be. If you did, then you will most likely be out of luck.

Some may make you sign something but any time I had a vehicle that was worked on I had to take it to a garage that was on the insurance company's list and they usually did an estimate and then repairs. Maybe they figure since the vehicle was sent there that they were allowed to fix it.

Don't you? I had thought that you had to use one of their approved garages. Mine is on thier list regardless but this is really good to know. Is it better to use a garage on thier list?

Ask the shop what all they have to do in order to be on the Program. They likely won't tell you, but... hey, they won't tell you if you don't ask either.

No Fred, and actually my 'real' computer is all messed up and having to use my work lap top so I'm not getting emails etc...man I hate when computer go down...anyway...all I found was I think it was Ontario, Canada, mandates that a full frame replacement is a manditory total loss..
Some state I remember reading one time, though has something funny on the books about frame damage and total losses...I'll stumble on it some time, and post it when I do..it likely is a full frame replacement as well, i just can't remember the particulars..
Fire, no one EVERY has to take their car to ANY shop other than the one they WANT to take it too...You're in a small town, so probably every shop is on the 'list' anyway...but never ever ever do you have to go to a recommended shop...are their some 'perks' for the vehicle owner as some carriers preferred shops...yeah, but they vary, and usually the perk is that the carrier will also warrant the repairs...which is a good 'selling' point especially in the economic condition the country is in...ie shop fixes car, six month later the paint is lifting or whatever, shop has gone belly up, if it's a carrier warranted shop the carrier will well, warrant the repair, rather than you (unsuccessfully) trying to hunt down and sue a bankrupt shop...

So let me repeat one more time...NO ONE EVER has to take their vehicle to ANY shop OTHER than the one they WANT to have repair their vehicle period, end of story, in every state in the union... :wink:

fire, your brothers truck betcha it was the steering box ....too bad he didn't come here, we could've loaded him with some ''fire'' power for that fight... :wink:

Lori...I will have to ask my brother if the steering box was checked. I never knew there was such a thing but that would make a lot of sense. I was laughing about your small town remark and everyone being on the list anyway..probaly is the truth.LOL. I would think I would feel better regardless taking it to a certified shop because of the whole warranty thing. Sometimes it may be safer than sorrier.

That's an interesting comment being that earlier Fireyone mentioned her brother's failed repair...

I wonder what happened to the Insurance Company warranty on that repair?? Shouldn't the insurer have stepped in and picked up the tab until the auto was repaired correctly or replaced the automobile if it could not be repaired correctly??
