Bodily Injury claims

Hi everyone...I'm a little confused about a bodily injury claim settlement
and its consequences.  I was in a car accident last year and my car was considered totaled.  At that time it did not appear the other driver had insurance.  She got ticketed for running a stop sign and no insurance.  My insurance company picked up the cost of the totaled car and all my medical bills.  PIP and med pay.  About 2 months ago my insurance company states they found insurance from the other driver and I was sent a check for $500 for my collision ded.  Now the other driver's insurance company wants to settle for Bodily Injury.I never got an attorney and this was my first accident.  I still have some pain in the neck and let the other adj know that I did not want to settle yet because I was still considering going back to get add'l treatment.  My PIP adjuster knew this.  But the adjuster still wants to settle. If I settle does the settlement include my medical bill or did the other company already pay my insurance company directly? Please help. :?

Seeing this first hand.

Confused, If you are still experiencing pain from the accident maybe you should follow up wiht your personal care doctor and ask what their opinion is and whether they think this is a lasting injury. Sometimes there is nothing like good old time to heal. I had severe whiplash and even after a year and a half I still get the tightness in the neck and so on. It may just be something you will have to deal wiht from time to time.

Thanks for all the great input. I believe I will f/u with my doctor. The adjuster has not yet made an offer but I'm not hopeful that he will make it anything worth holding my breath for. Either way I've gone this long without the $$$ and so whatever the offer is I guess it would be ok. :?

I would make sure you did a follow up first before excepting an offer. Remember an offer is usually negotiable. Believe me I know all about waiting...sometimes when things are piling up it seems like forever.

I was a passenger in someone elses car and was injured in a one car accident. I have just had surgery on my neck (disc removed and fused) and have a torn rotaor cuff as well as unspecified back injuries. I have been off work now for two months and looks like I will be off for at least two more. In december of 08 the claims adjuster offered me $1,000.00 to settle this claim. I refused of course! I am really reluctant to get an attorney as they ususally take about a third of your settlement, and that money is needed for paying things like my house payment that I will be behind on ( I have used most of my savings and disability insurance does not kick in for another 3 months). I was wondering how much in rough figures I should be asking for

i was in an accident where we almost hit a deer the girl i was riding with went off of the road and we flipped over, i had some back and neck pain and a 2 inch scar on the side of my face. The insurance company offered me 11,000 on top of paying my medical bills that totalled up to about 13,000. so i took the 11,000 and got all my bills paid. so if i were you guys just ask for double the bills and add in loss of wages and go from there. stand on the fact that you suffered and that you deserve to be paid for it. the n send me a check for 6 percent in the mail :)

Take it from my experience with two accidents that I had almost back to back. Both were rear-end hits, so I was not to blame, but the first one I tried to do alone and the company that was supposed to settle my case, spent a month trying to get me to talk about the accident, fill out this paper, fill out that paper, sent out investigators, and basically tried to prove I was at fault. THe moment I got a lawyer, they stopped all the BS and they can not contact me, but instead have to deal with the lawyer. TO make a long story short, I am going to win both cases, and who cares if the lawyer gets his share. He saved my case. I can tell you this, you will be taken to the cleaners by a mean spirited adjuster. He works for them, not you. His or her job? Give you peanuts and make sure you lose. :idea: :idea:

you must have your neck looked at because u will have problems in the next 5-10-20 years and u want it looked at now while the insurance claim is still open and paid for. Get an MRI. Go to a chiropractor for two opinions. Go to the doctor for an MRI first. Then you will go thru some therapy. Wait as long as u can to settle and get healed. Refuse their first two offers and seek a lawyers free consultation with all your medical records and wages lost, your time etc. see if they agree on their offer. take your wages and medicals and times that by 3 or 5 and request that first. lawyers do take a third. What are the policy limits on the insurance plan.
