had a car accident

Ok.....here's the 'deal'. Yesterday I was in a car accident. Someone had rear-ended me. Her hood and front of the car were smashed in. My back bumper was bent down. She had to have her car towed. I drove away. I called her Insurance Co and told them what happened. Her Insurance Co. told me if "their insured doesnot file a claim, there is nothing they can do." Is this true? Since SHE rear-ended ME, isn't the accident automatically HER fault? I thought it was in the state of PA.

The adjuster, from the OTHER driver's insurance, and he said my damages would 'outweigh' the price of the car.............so...he wrote on his paper work the "car is totaled!" OMG!!!!!! I'm really bummed!! My credit's bad and I can't finance another car through Citifinancial again!! Gosh...just don't know what to do!!

Is your car still driveable? Why don't you retain the salvage? What is the yr/make/model/ mileage and options...do you owe anything on it? Is it legally driveable and safe?

I'd agree with Lori, if you can't afford another car for poor credit the only other option is to look at the possibility of retaining the car. But it needs to be checked whether the car can be retained and drive safely on the road.

You would then need to spend a lot on getting it repaired and inspected by DOT before start operating it again. I think you can't actually drive a car with salvage title in PA.

I've talked to my mechanic...he DID look at it, too. HE even told me that the "car is unsafe to drive." When the other drive hit me, she bent the frame, in the rear of the car. I'm working on a few options. ...Citifinancial ( who I had my loan through, for the Jeep..) can't re-fianance another car, but..they CAN use the Title ( when I get another car) for collateral for the remaining of the loan. ALSO..........( this was a relief)....when I was in a previous accident, ( hit black ice and hit a guard rail), my 'Collision Coverage' sent my mechanic for the work that had to be done, from THAT accident. However.....because of my busy schedule, not ALL of the work was finished yet. SO.........not all of the money was used...about $1500.00. My mechanic is going to send me a check for the difference ( hope I'm explainging this clearly). So....that's something to 'go on' anyway. ( Feel a little bit today....had a rough day yesterday!!) :cry:

You do understand that when they determine the ACV for your vehicle, that it's highly likely they will deduct the unrepaired prior damage from your ACV right?

SD do you not have GAP insurance on this note? If you 'roll' your balance from this note into yet another loan, you will just be getting yourself in deeper and deeper...

Did you ask your 'mechanic' (and I hope it's really a body tech, and not a mechanic)...what he would charge you to get your vehicle safe, and driveable?

I was just thinking.... (likely dangerous) but here goes....

When an automobile is totaled in Pa. Sales Tax, Transfer Fees for license plates and Title costs are added to the settlement amount. Its my understanding it is this way because, if the at fault party had not damaged the other persons car they would not be incurring these expenses, so its part of the loss.

So..... shouldn't the necessary Fees that sdchargersfan has to pay to have her car inspected at an Enhanced Inspection Station, and the Fee's needed for an R-Title be paid by the at fault party??

Okay Fred, This is my understanding about the situation....the insurance indeed has said that SD won't be able to drive the car on the road since they wouldn't pay for its repairs and therefore would compensate her for the loss of transportation, sales tax and the other expenses incurred.

Now if she wishes to retain the vehicle why would the insurance company be responsible for the fee’s and R-title?

If they paid her for the first (title and transfer fees meaning she's buying a different car) then they wouldn't owe the other...retaining salvage is always a choice...BUT in making that choice the owner assumes any costs incurred by doing so...

Yes..LORI,..it's a body shop. great people!! Anyway....My mechanic would charge about the same amount that the adjuster came up with (the amount would 'outweigh' the Blue Book amount of the car). The Blue Book value, of the car, will go toward my loan, that I had on the car. I have some pretty good 'leads' about someone selling a few good, used cars. Thanks for everyone's advice. LORI...I don't know what GAP Insurance means...can you explain?
