Car was totaled...and we owe more then it's worth.

I was involved in a non at-fault accident. My car was a total loss and we owe more then it's worth. Does the insurance company pay the lienholder or do they cut us a check? Also...if they cut us a check are we obligated to pay off the lienholder. I don't have money for a car payment and am screwed right now as for getting a new vehicle. What happens to the car when it's a total loss? Canwe also get money for the salvage of the car?

yes the lienholder advised they did not handle that part of it, and I was trying to give it to the junk yard because it is totaled

Good question I never thought to ask that. Around here people would haul it for free because there is alot of money in junk cars. It is usually the ones who don't like 9-5 jobs (if ya know where I'm coming from). So they go around asking people if they want the old cehicle removed.
I can say one good thing it sure cleaned up the neighborhood rather quickly.

How about donating it to the local high school auto class? They will get to work on something and you will get the tax write-off.

Not to mention, you'd be really cool doing that.

If I had one I would. It was others in the neighborhood that was just letting them haul them away to get cash. I could have 40 of them in my driveway and wouldn't let these type of people take one. I would haul it away myself..piece by peice...or give it to the high school before I would let these welfare and disability scammers make money from anything I owned. Sorry it is a sore point with me.

If it were me I would want them to pay the leinholder because that would be one less thing that I would have to deal with. I suppose that it could be either way but it would be my preference that it go to the leinholder.

As though for the junk cars I would not just let people who are living off the funds of something like this and not working full time take a vehicle for the money they would get to junk it. I got an e-mail recently from Summit. It it is a place you can buy cheaper parts for older vehicles. They say that congress is trying to pass some bill that you will get a check if you take a used vehicle in and scrap it. I guess the government will pay you some small amount of money for doing this. Proablem is good will and Salvation Army have a program like this running except they actually give the cars to people who need them. By doing this the government hopes to get the automakers sales boosted (since people will need new cars if otrhers start scrapping their used ones) but it will raise the price of parts for older vehicles and m,ake them harder to find. Not sure this is a good idea.

Seems like there is ALWAYS a 'Catch 22' in trying to help someone. 'You scratch my bck, I scratch your' type of thing. What ever happen to just plain giving if you have it to give, without expecting something back?
