What should i do if i can't find the other person to sign

My insurance wrote me a check to me and my uncle..Now my uncle is no where to be found, no contact or anything. He's not even on the insurance policy n e more. Well he was never in the whole car accident problem. The insurance wont do anything about it and i cant cash it anywhere..any clue wat i should do.

When the one came from my insurance company my hubby's name was not on the release or the check which was why I thought the first check was made out to both of us because of the him being on the title

Could be two things at play here Fire, either UIMBI in your state doesn't allow for spousal loss of consortium claims or your adjuster screwed up.. :wink:

No big deal, at least not for me. I was wondering what would happen in a situation where the hubby and wife are estranged. Does the person who was injured have to give the other one half of their settlement, even though they were not involved in the wreck, just because they were married? Doesn't sound very fair but I imagine there is a solution somewhere for something like this.

That would be between the couple, they just have to have the signatures of both on the releases and draft

If it were a separation but still married issue then it would probaly be between the couples and their atty. lol

and me insisting that I cannot give them the draft without the spouse signing the release, then they have to get them to sign the draft..



What would happen to the claimant if he/she indeed can't manage the spouse to sign the draft? Would he/she then have to go to the court of law for his/her share?
