My car was backed into

by amy reed » Thu Oct 16, 2008 10:21 pm

My car was backed into by a uhaul truck while parked at work. My bumper was ripped off. I've sent the claims adjuster everything she told me she needed after finally haggling her contact info out of the operator. I spoke with her once, three days after the accident. The accident was two weeks ago, she still wont's answer the phone or respond to my email asking her to verify she recieved the information. What can I DO??? I need my car fixed.

With a rental car you are typcially just purchasing a damage waiver, which is only your deductible...unless you don't have coll and comp...on the uhauls, it would be dependent on the state if it were required, and if you don't have coll/comp then you would likely have to take theirs, also unlike a rental car, not sure the uhaul would met the definition of temp substitute vehicle...it would non-owned, but still I think some states allow uhaul and others to mandate their ins is purchased, in this case...good thing.

At least there would be some type of coverage. I hope the poster stops back and lets us know how things are going.

Call the insurance company or call uhaul's customer service line and find out if the driver had the insurance through them. You will get your car fixed. If you have to and still have problems file it through your insurance company and have them go get it for you. I would do this as a last resort, since the driver who was at fault's insurance should take care of it for you.

I think if they file it through there insurance company then they will be respon sible for their deductible un til they can get the other side to take responsibility. I am not certain on this but when I called mine after someone totaled my truck and we didn't have the other drivers info this is what they had informed me.

Hi everyone, orignal poster here. Waiting on 'audit team' to do their thing. How longdoes that usually take. This is getting ridiculous. Can I threaten legal action to make them get a move on?

Amy you can threaten all you want...personally I would tell them that they are leaving me no choice but to file a complaint with the Dept of Ins unless you get some REAL answers about how much longer this is going to take, and WHY EXACTLY it has taken this long thus far, IN WRITING...see what that does
