Insurance claim check

Hi there,
I shipped my car to the Big Island with Young Brothers. (I sent there because I had it sold) Well, I went to pick it up but was damaged so I couldn't sale it. Then I was told to take the car out to some body shops to get two estimates, I turned the estimates in then waited for a couple weeks, no response so I start to call them, finally they went to inspect the car (I wasn't there). They deduct couple things from the estimate & they were going to pay me, them they called back & told that they have to make the check out to my name & the body shop name.
Facts:

1- They damaged my car!
2- I don't live in that island to deal with the body shop (I live in Oahu).
3- I was trying to speed up the process so I took the car to any body shop for estimates.
4- I lost the opportunity to sale this car

In a letter from young BRothers, they say, "Aon Benfield, as cargo claims administrators for young brothers, limited. . ."
Also on this letter from young brothers account administrator the letter head says AON Specialty
It seems they are linked some how?
How should I proceed?
Is it possible to add to my claim the loss of the sale of my vehicle and loss of work days dealing with the estimates etc?

I would say they are self insured most likely up to a certain point (dollar amount).

They are either self insured or the carrier uses this (basically) independent adjusting company that specalizes in shipping claims..You need to ask the person from Aon Benfield if the Young Brothers are self insured or if no the name of the insurance company that they have their policy with....I'd also tell them if they don't pay to me the amount of damages in full I will file a complaint with the Hawaii dept of insurance (then do it) even self insured have to abide by the fair claims practices...then I would get an attorney..and not only sue for the damages but also for third party bad faith (which it appears Hawaii allows)...but make sure you get in writing their offer...and that they will only pay the full amont to a shop. did you ask them their stance on that? Why they think they can chose two different amounts to pay?

Doubt you could get either one...certainly I would ask for it and a lawyer would include this as well, but chances of collecting are unlikely...why would you miss work 'dealing with estimates etc'? generally when people say that to me, it's totally because they chose to be off work for this, no one ask them to...

I called Aon Specialty agent/broker Leslie Barrows several times asked in writing (fax or e-mail) what she told me, NO response. . . I also asked to have car shipped back to Oahu (where I live) to have car worked on at Land Rover Dealership and she said that they would Not pay for it to be shipped back.
Can Hawaii Dept of Insurance help me to resolve this? What about that "third party bad faith" thing? Can you help me Lori? Thank you Jenn

Yes, you need to contact them today...they have a consumer advocate or minimally a complaint form...

From what I read it appears Hawaii recognizes third party bad faith...if you can find a decent attorney that will give you an inital consult free (all usually do) and handle it on a percentage basis, i'd look into it, no atty worth their salt will take on a bad faith case unless they 'know' they can win it...document every single phone call and email...call that adjuster twice a day, requesting the information in writing, ask to speak to his/her supervisor, manager, vp of claims...you need to start playing hard ball with these morons.

If you elect not to have the repairs done at a body shop we can request a cash settlement. Cash settlements are based on the lowest approved estimate amount less the Parts Adjustment (markup of 50%), less all taxes and Additional Costs with a 25% deduction in labor.

Please let me know how you elect to proceed.

I have NEVER heard of such a thing in my life! any other adjusters out there ever hear of this especially on a third party claim? OP please contact hawaii's Dept of ins. and see if this is allowed...and let us know, i'm going to be out for a while i'll try and do some research too..this is nuts!

This doesn't sound right, but I have a question. Is there anything in the contract you signed with the hauler regarding damage to freight?
