I recently got a DWI - I remember, hazily, leaving the bar and seeing some damage in my car, a dent on the drivers side. Afterwords everything becomes blank, I do not remember driving or anything else until I was with the officer and he was doing the sobriety tests. I got arrested for DWI and that was that. No mention of anything else. Next day I get my car out of the impound and I see the damage, since there was no report of any accident and I had no recollection I made my claim for this happening in the parking lot. A week passes by and I get a call saying that there is now a claim against me, claiming that I hit another car; as I have no recollection of what happened and no information from the police or my dwi lawyer until he gets a report. How do I go about this? They sent me a check for the claim I made, but I have not used it, due to the fact that I was surprised by this claim against me... I also gave my statement for the claim against me stating that I do not recall the events. If there is a possibility that something did happen I don't want to look bad with the insurance. What can you recommend? All advise is most appreciated. Thank You.

In regard to the possibility of you colliding with another car while in a blacked-out state, it is better you not remember because you could possibly be charged with a class D felony of leaving the scene of an accident (if the damage to the other car is high enough). But, if you are blacked out, you have no knowledge of the collision, which is an element of the crime of LSA.
As for the claim, let your insurance company take care of it. This is the purpose of an insurance company. Aside from this, insurance companies may only adjust your premiums due to the DWI for only a few years after the DoR hearing determination and suspension.
I also love these people who get on here yelling about drunk drivers. I'm sure none of you have driven while intoxicated... :roll:
